Spotify and the massive three labels need Anna’s Archive blocked from distribution, citing a “brazen theft of thousands and thousands.”

Spotify has teamed up with main label teams to file a federal lawsuit focusing on Anna’s Archive, a shadow-library community that the grievance describes as a “decentralized group of on-line piracy web sites.” The alleged scale of the operation places the case in uncommon air, with the plaintiffs floating a statutory damages ceiling that sums as much as an eye-watering $12.9 trillion.

In line with the grievance, filed within the Southern District of New York, the plaintiffs allege Anna’s Archive harvested metadata for about 256 million tracks and copied 86 million music recordsdata from Spotify, a quantity which they declare quantities to 99.6% of all streams on the platform.

“This motion arises out of the brazen theft of thousands and thousands of recordsdata containing practically all the world’s business sound recordings by a gaggle of nameless web pirates with no regard for the regulation,” reads the swimsuit.

Choose Jed S. Rakoff granted an emergency short-term restraining order and the courtroom later entered a preliminary injunction, which successfully now bars Anna’s Archive from internet hosting, distributing or linking to the recordings. The order additionally directs third-party service suppliers resembling area registrars and internet hosting firms to disable entry to Anna’s Archive domains and protect data that might assist establish the operators.

As if the dimensions of the alleged operation wasn’t surprising sufficient, the grievance seeks statutory damages of “as much as $150,000 for every work” infringed. For those who apply that to 86 million tracks, you get roughly $12.9 trillion. That’s the ceiling for doable damages as U.S. copyright regulation treats $150,000 because the willful-infringement most per work, and awards are in the end discretionary.

“Given the large magnitude of defendants’ unlawful copy and supposed mass distribution of the file firm plaintiffs’ sound recordings, the extent of the file firm plaintiffs’ losses arising from defendants’ unlawful conduct is extraordinary,” based on the grievance.

The operators of Anna’s Archive haven’t publicly responded to the lawsuit on the time of this writing.
